Application process
To apply for eligibility for instruction in English for a child, the parent or the person having custody de facto of the child must contact the educational organization (elementary or secondary school), which will tell them what documents to provide, depending on the type of application. The applicant must complete the appropriate application form and attach any required supporting documents. In all cases, the child’s birth certificate must bear the names of both parents and must be enclosed. If a birth certificate cannot be provided, any other official document issued by a competent authority and attesting to the child’s date of birth, sex and filiation may be submitted.
The educational organization then forwards the application and the required supporting documents to a person designated by the Ministère to check if the child is eligible to receive instruction in English and render a decision on this subject.
This person informs the applicant of their decision regarding the child’s eligibility in writing. Completed applications are generally processed within 15 working days, in accordance with the Declaration of Services to Citizens.
If the parent wishes to contest an unfavourable decision made by the designated person, they have 60 days to file an appeal with the Administrative Tribunal of Québec. If they wish to claim a serious family or humanitarian situation, they have 30 days to submit an application to the Examining committee
