Budget Rules
School boards
Under the Education Act (CQLR, c. I-13.3; 1997, c. 96, s. 143), the Minister is responsible for establishing the budget rules.
Therefore, in accordance with section 472 of this Act, each year, after consulting with the school boards, the Minister shall establish the budget rules to determine the amount of operating expenses, capital expenditures and debt service expenses allowable for the purpose of subsidies to be allocated to school boards annually and submit these rules to the Conseil du trésor for approval.
Furthermore, under section 475 of the Education Act (CQLR, c. I-13.3; 1997, c. 96, s. 143), the Minister must include in the budget rules the payment of fiscal balance subsidies to school boards.
These budget rules do not apply to the Cree, Kativik Ilisarniliriniq and du Littoral school boards or to the Naskapi School, each of which has its own budget rules.
Private educational institutions accredited for purposes of subsidies
Under the Act respecting private education (CQLR, c. E-9.1), the Minister is responsible for establishing the budget rules.
Therefore, in accordance with section 84 of this Act, each year, the Minister, after consulting the accredited educational institutions, must establish budget rules to determine the amount of subsidies to be paid to accredited educational institutions for dispensing the educational services in question and submit these rules to the Conseil du trésor for approval. This guide, available only in French, provides information for the school boards and private educational institutions accredited for purposes of subsidies on the legal status of students coming from outside Québec. It is also a tool to assist educational institutions in establishing the applicable criteria regarding school fees and the supporting documents that must be placed in a student’s file.
The information in this guide also helps the persons concerned meet student enrolment verification requirements.
Supporting documents and school fees required from students coming from outside Québec
Section 473 of the Education Act (CQLR, c. I-13.3) and section 90 of the Act respecting private education (CQLR, c. E-9.1) state that the budget rules may prescribe the additional financial contribution to be collected from persons who are not resident in Québec within the meaning of the Regulation respecting the definition of resident in Québec (CQLR, c. E-9.1, r. 2), whether they are Canadians who are not resident in Québec or international students. These sections also provide for exceptions applicable to the collection of that contribution for certain categories of persons. School transportation
Under the Education Act (CQLR, c. I-13.3; 1997, c. 96, s. 143), the Minister is responsible for establishing the budget rules.
Moreover, section 300 of this Act stipulates that, “Each year, the Minister shall establish and submit to the Conseil du trésor, for approval, budgetary rules to determine the amount of subsidies granted to school boards providing student transportation.”
These budget rules apply to all school boards, with the exception of the Cree, Kativik Ilisarniliriniq and du Littoral school boards, as well to all subsidized private educational institutions that organize school transportation in accordance with section 62 of the Act respecting private education (CQLR, c. E-9.1).

Special-status school boards and the Naskapi School
The Cree, Kativik Ilisarniliriniq school boards and the Centre de services scolaire du Littoral have special status because they were not established under section 111 of the Education Act.
The Cree and Kativik Ilisarniliriniq school boards were actually created in 1978 under the James Bay and Northern Québec Agreement and the Centre de services scolaire du Littoral was created under the Act respecting the School Board of the North Shore of the Gulf of St. Lawrence, passed in 1967.
The Minister is responsible for developing funding rules for these school boards, subject to the provisions of the James Bay and Northern Québec Agreement and the Act respecting the School Board of the North Shore of the Gulf of St. Lawrence. The Minister must also submit these funding rules to the Conseil du trésor for approval.
The Naskapi School was created under the Northeastern Québec Agreement and the Central Québec School Board was mandated to provide administrative support. This school comes under The Education Act for Cree, Inuit and Naskapi Native Persons.
